LIMITED WARRANTY GUIDELINES
As specified in your Real Estate Purchase Contract, the only warranty provided for your home is provided by Distinctive Homes. While Distinctive Homes strives to build a defect-free home, we acknowledge we may have miss a detail or that something in the home may not perform as intended. When either occurs, we will make necessary corrections. In support of this commitment, we provide you with a Limited Warranty. In addition to the information contained in the Limited Warranty itself, this manual includes details about the one-year material and workmanship standards. The criteria for qualifying warranty repairs are based on typical industry practices in our region and meet or exceed those practices for the components of your home. However, Distinctive Homes reserves the right to exceed these guidelines if common sense or individual circumstances dictate, without being obligated to exceed all guidelines to a similar degree for all homeowners.
TERMS: The terms of the Limited Warranty begins on the date in which your home is deeded to you. That date is referred to in the Limited Warranty as the “Closing”.
COVERAGE: Except as otherwise provided herein Distinctive Homes warrants that for a period of (1) year after closing they will repair or replace at no charge to you, defects in workmanship and materials in the home which are due to noncompliance with accepted standards and practices within the home building industry or as outlined in this manual.
MANUFACTURER’S WARRANTY: Distinctive Homes assigns and passes through to you the manufacturer’s warranties on appliances and other components of your home. The following are examples of such appliances and components, though not every home includes all of these items, and some homes may include appliances or components not on this list: range, dishwasher, garbage disposal, water heater, and HVAC equipment.
EXCLUSIONS FROM COVERAGE: Distinctive Homes does not assume responsibility for any of the following, all of which are excluded from the coverage of the Limited Warranty: Appliances, fixtures and components (including their fitting, attachments, controls and appurtenances) which are determined by law to be “consumer products,” as defined by the Magnuson-Moss Act (Public Law 93-737) · Ordinary wear and tear and deterioration of your home · Loss or damage caused by homeowner’s failure to keep and maintain the home in good repair and condition · Defects which are the result of characteristics common to the materials used, such as, but no limited to, warping, deflection and cracking of wood and wood 7 products; fading, chalking, and cracking of paint due to sunlight; cracks due to drying, curing, expansion and contraction of concrete, stucco, plaster, bricks and masonry; drying, shrinking and cracking of caulking and weather-stripping · Defects in items installed by you or any person other than Distinctive Homes, our subcontractors, or agents if not requested or contracted by Distinctive Homes · Any change or alterations done by you or any other person other than Distinctive Homes, their subcontractors, or agents if not requested or contracted by them · Accidental loss or damage due to the elements including, but not limited to, fire, smoke, lightening, hail or windstorm, rainstorm, and water. · Conditions resulting from condensation (including mold), excessive moisture resulting from life-style, or expansion and contraction of materials. · Paint or wallpaper applied over newly dry or walled interior walls. · Landscaping, including sod, seeding, shrubs, trees, and plantings, including any existing landscaping prior to construction.
The Limited Warranty is the only express warranty Distinctive Homes provides. Implied warranties, including, but not limited to, warranties of mechanical ability, fitness for a particular purpose, and habitability, are limited to the warranty periods set for herein and as agreed upon in the Real Estate Purchase Contract.
NON TRANSFERABLE: The limited Warranty is extended to you only if you are the original purchaser of the home. When the original purchaser sells the home or moves out, this Limited Warranty automatically terminates.
AINTENANCE: Maintenance, for which the homeowner is responsible, is excluded in this Limited Warranty
REPORTING PROCEDURES: All service requests should be submitted to Distinctive Homes through the forms provided herein or online www.distinctivehomes.com and submitted by email or mail to Distinctive Homes. ·
Note: Distinctive Homes warranty service system is designed to accept written reports of non-emergency items. This provides you with the maximum protection and allows them to operate efficiently, thereby providing faster service to all homeowners. Emergency reports are the only reports accepted by phone. Please call subcontractor listed at the back of this book for any emergency items.
WARRANTY CLAIM: · During the end of the eleventh month of your materials and workmanship warranty, you may submit a year-end report. We will also be happy to discuss any maintenance questions you may have at that time.
EMERGENCY SERVICE: · As defined by the limited warranty, “emergency” includes situations such as: o Total loss of hear when the outside temperature is below 50 degrees o Total loss of electricity (Check GFCI resets, breaker panel, exterior breaker and with the utility company before reporting this circumstance to us or the electrician). o Total loss of water. (Check with the water department to be certain that the problem is not a general loss in the area.) o Plumbing leak that requires the entire water supply to be shut off o Gas leak. (Contact your utility company or plumber if the leak is at the furnace or water heater supply lines) · During business hours, after hours, or on weekends or holidays, call the necessary trade contractor directly. Their phone numbers are listed on the Emergency Phone Numbers sheet at the back of this manual.
KITCHEN APPLIANCE WARRANTIES: The manufactures of kitchen appliances will work directly with you if any repairs are needed for these products. Customer service phone numbers are listed in the use and care materials for each appliance. Be prepared to provide the model and serial number of the item and the closing date on your home. Appliance warranties are generally for one year; refer to the literature provided by the manufacturer for complete information.
SERVICE PROCESSING PROCEDURES: You can help us serve you better by providing complete information, including: · Name, Address, and phone numbers where you can be reached during business hours. · A complete description of the problem, for example, “guest bath – cold water line leaks under sink,” rather than “plumbing problem” on the form provided in the back of manual. When we receive a warranty service request, we may contact you for an inspection appointment. Warranty inspection appointments are available Monday through Friday, 8am to 4pm. Generally reported items fall into one of three categories: · Trade contractor item · In-house item · Home maintenance item If a trade contractor or an in-house employee is required to complete repairs, Distinctive Homes issues a warranty work order and a customer service representative will contact you to schedule the work. Warranty work appointments are available Monday through Friday 8 am to 4 pm. Distinctive Homes intends to complete warranty work orders generally within 14 working days, unless you are unavailable. The Homeowner must provide the Builder’s Construction representative with a key to the home or some other means of access to the unit. In the event other arrangements are necessary to address warranty service requests, Builder shall provide buyer with the phone numbers of the subcontractors to make arrangements outside the aforementioned provisions. Distinctive Homes will attempt to contact you 2 times. If they are unable to reach you and don’t receive any return phone calls, it will be necessary
